Terms and Conditions

Webenito is a Boutique Digital Marketing Agency based in Ireland, specializing in Website Design, eCommerce Web Design, SEO services, PPC management, and website support for standard and eCommerce websites. We understand that some of our clients may find it difficult to pay for our services in one lump sum, which is why we have created a 6-month payment plan for selected packages. This payment plan allows clients to spread out their payments over a 6-month period, making it easier for them to budget and manage their cash flow.

The 6-month payment plan applies to three groups of clients: Private Individuals, Irish Businesses, and Online Retailers. We have created two packages for each group, each of which includes a combination of our services tailored to meet their specific needs.

The packages for Private Individuals are:

• the Web Design & SEO Boost Package
• the Web Design & PPC Boost Package.

The packages for Irish Businesses are:

• the Entry-Level Plan
• the Enterprise-Level Plan.

The packages for Online Retailers are:

• the Retail Entry-Level Plan
• the Retail Enterprise-Level Plan.

The following terms and conditions apply to the 6-month payment plan and the packages it applies to. By signing up for the payment plan and using our services, clients agree to abide by these terms and conditions.

To be eligible for the 6-month payment plan, clients must fall into one of the following three groups: Private individuals, Irish businesses, or Online retailers, and they must be residents of Ireland and/or have their business registered in Ireland.

Private individuals who are looking to boost their online presence can choose from two different packages: the Web Design & SEO Boost package or the Web Design & PPC Boost package. The Web Design & SEO Boost package includes website design basic, one-time SEO services, and website support. The Web Design & PPC Boost package includes website design basic, one-off PPC setup, and website support.

Irish businesses can choose from two different packages as well: the Entry-Level Plan and the Enterprise-Level Plan. The Entry-Level Plan includes website design pro, one-time SEO services, one-off PPC setup, and website support. The Enterprise-Level Plan includes website design pro, ongoing SEO services, ongoing PPC management, and website support.

Online retailers can also choose from two different packages: the Retail Entry-Level Plan and the Retail Enterprise-Level Plan. The Retail Entry-Level Plan includes eCommerce basic package, one-time SEO services, one-off PPC setup, and website support. The Retail Enterprise-Level Plan includes eCommerce Pro package, ongoing SEO services, ongoing PPC management, and website support.

Clients must select one of these eligible packages to be eligible for the 6-month payment plan.

The 6-month payment plan allows clients to spread their payments over a 6-month period, making it easier to manage their finances while still receiving top-notch digital marketing services from Webenito.

Clients will make a total of six payments, with the first payment due on the date of signing the agreement, which can be done either digitally or in person. The remaining five payments will be due on a monthly basis, with the due date being the same day of each subsequent month as the first payment due date. For example, if the first payment is made on the 1st of the month, the subsequent payments will also be due on the 1st of each subsequent month.

Clients are responsible for ensuring that payments are made on time. Late payments will incur a fee (as stated in the 6-month Payment Plan Agreement), and if a payment is more than 14 days late, we reserve the right to suspend our services until payment is made. Clients will be notified of late payments via email and given a 7-day grace period to make the payment before any suspension of services takes place.

In the event that the payment plan is cancelled within the first 14 days after the agreement is signed, whether digitally or in person, the client will receive a full refund of any payments made, except for the first payment, which covers our work and time invested into the project. Please note that we do not offer refunds for any remaining portion of the payment plan period that has not been utilized.

After the 14 days have passed, the client will not be able to cancel the agreement as the web development process has already started, and in many cases, SEO and PPC services have already commenced. Therefore, clients are liable to complete all six payments as stated in the agreement. If a client fails to complete all six payments, Webenito may claim the full sum to be paid at once.

By agreeing to these payment terms, clients acknowledge that they have read and understood the terms and conditions of the 6-month payment plan and agree to abide by them.

Clients may cancel the 6-month payment plan within the first 14 days after the agreement is digitally signed or in person. If a client chooses to cancel within this timeframe, they will receive a full refund of any payments made, except for the first payment, which covers our work and time invested into the project.

After the 14-day period has passed, there is no option to cancel the agreement, as the web development process has already started, and in many cases, SEO and PPC services have already commenced. Clients are liable to complete all six payments as stated in the agreement.

If a client fails to complete all six payments, Webenito may claim the full sum to be paid at once. In such a situation, clients will be notified via email of the outstanding balance and given a grace period of 14 days to make the full payment. If the full payment is not made within the grace period, Webenito reserves the right to take legal action to recover the outstanding balance.

By agreeing to these terms and conditions, clients acknowledge that they have read and understood the cancellation policy and agree to abide by it.

Each package includes specific services as outlined below:

For Private Individuals:

• Package #1 Web Design & SEO Boost includes Website Design Basic, One-Time SEO Services, and Website Support.
• Package #2 Web Design & PPC Boost includes Website Design Basic, One-Off PPC Setup, and Website Support.

For Irish Businesses:

• Package #1 Entry-Level Plan includes Website Design Pro, One-Time SEO Services, One-Off PPC Setup, and Website Support.
• Package #2 Enterprise-Level Plan includes Website Design Pro, Ongoing SEO Services, Ongoing PPC Management, and Website Support.

For Online Retailers:

• Package #1 Retail Entry-Level Plan includes eCommerce Basic package, One-Time SEO Services, One-Off PPC Setup, and Website Support.
• Package #2 Retail Enterprise-Level Plan includes eCommerce Pro package, Ongoing SEO Services, Ongoing PPC Management, and Website Support.

Clients should refer to the package details on our dedicated pages on the Webenito website for Private Individuals, Irish Businesses, or Online Retailers, as applicable, to ensure they understand which services are included in their chosen package.

Work on the project will begin after the first payment has been received. In some cases, work may have already begun on SEO and PPC services, and in such cases, the client will be notified accordingly.

By agreeing to these terms and conditions, clients acknowledge that they have read and understood the services included in their chosen package, as outlined on our website, and agree to receive them from Webenito.

Webenito will not be held responsible for any loss of data, revenue, or profits resulting from the client’s use of their services. The client assumes full responsibility for any information or content they provide to Webenito. Webenito will not be held responsible for any errors or inaccuracies in the content provided by the client.

Webenito does not offer any warranties or guarantees regarding the performance of their services. This is because the success of digital marketing strategies can vary depending on various factors beyond our control, such as changes in search engine algorithms, competition, and market trends. However, we will make every effort to provide the best possible services to our clients and achieve their desired outcomes.

In addition, Webenito will not be responsible for any loss resulting from force majeure events, such as natural disasters, wars, or government actions, that may affect the provision of their services.

At Webenito, we take the privacy and confidentiality of our clients’ information very seriously. All information provided to us, including any sensitive information or intellectual property belonging to the client, will be kept strictly confidential. We will not disclose any information provided to us to any third party without the explicit written consent of the client.

We understand that many clients entrust us with sensitive and proprietary information and we take our responsibility to protect this information very seriously. We have strict security measures in place to ensure that all information provided to us is kept secure and confidential.

We also expect our clients to maintain the confidentiality of any information related to our services, including our pricing and payment plans. Any unauthorized disclosure of this information may result in legal action.

By engaging our services, clients agree to maintain the confidentiality of any information related to our services and acknowledge that any breach of confidentiality may result in legal action against them.

In accordance with the laws of Ireland, these terms and conditions will be governed by and interpreted in accordance with Irish law. Any disputes arising from the agreement will be subject to the exclusive jurisdiction of the Irish courts.

Webenito and the client agree to submit to the personal jurisdiction of the courts located in Ireland for the purpose of litigating any such claims or disputes. By agreeing to these terms and conditions, the client acknowledges and consents to this jurisdiction and venue.

Webenito may amend these terms and conditions from time to time at its discretion. Any changes made to these terms and conditions will be published on our website.

Clients are responsible for regularly reviewing these terms and conditions. Continued use of our services after any changes to the terms and conditions will constitute acceptance of the revised terms and conditions.

Any additional terms or conditions that apply to the payment plan will be outlined in the agreement.

In the event of any conflict between the agreement and these terms and conditions, the agreement will take precedence.

Any changes to the terms and conditions must be agreed upon in writing by both parties.

These terms and conditions, together with the agreement, constitute the entire agreement between the client and Webenito regarding the payment plan and the services provided.

In conclusion, the 6-month payment plan offered by Webenito allows clients to spread the cost of their chosen package over a 6-month period. Eligible clients include private individuals, Irish businesses, and online retailers, each with their own eligible packages. Payments are due on specific dates, and late payments will incur a fee and may result in the suspension of services.

Clients have 14 days to cancel their agreement, after which they are liable to complete all six payments as stated in the agreement. Webenito is not responsible for any loss of data, revenue, or profits resulting from the client’s use of their services and does not offer any warranties or guarantees regarding the performance of their services.

All information provided to Webenito will be kept confidential, including any sensitive information or intellectual property belonging to the client. Any disputes arising from the agreement will be resolved in the designated jurisdiction.

Our Minimum 6-month plan is a minimum requirement for all ongoing services, including Ongoing SEO Services, Ongoing PPC Management, Website Care, and Website Care Pro plan. By opting to use our ongoing services, you acknowledge and agree to our minimum 6-month plan, which is designed to ensure that our clients receive the maximum benefits from our services and see measurable results. Please note that this plan is not a contract or agreement.

To ensure that there is a clear understanding between us and our clients, we require written confirmation via email or any other form of communication. By confirming the minimum 6-month plan, you acknowledge and agree to the terms and conditions of this plan.

All payments for ongoing services will be billed monthly in advance. Once you have confirmed the minimum 6-month plan, you will be billed for the full 6 months of service. No refunds will be given for early termination of services, as this plan is not a contract or agreement.

We invest significant time and resources into the initial stages of our ongoing services to provide you with the best possible results. However, we cannot guarantee specific results or outcomes. The success of our ongoing services is dependent on many factors outside of our control, including changes to search engine algorithms, website updates, competition, and changes in your industry.

While there is no contract or agreement associated with our minimum 6-month plan, we reserve the right to terminate ongoing services at any time if we feel that our services are not being used appropriately. We also reserve the right to terminate services if you fail to pay for ongoing services or breach any of the terms and conditions outlined in this plan.

After the minimum 6-month period, you may continue to use our ongoing services for the same monthly fee, provided that the fee has not changed. If the fee has been changed, we will notify you in writing at least 30 days prior to the change. At that time, you may choose to continue using our services at the new fee or terminate the ongoing services.

To the fullest extent permitted by law, we will not be liable for any direct, indirect, incidental, special, or consequential damages that result from the use or inability to use our ongoing services, even if we have been advised of the possibility of such damages.

You agree to indemnify and hold us harmless from any claims, damages, losses, liabilities, and expenses arising from your use of our ongoing services, including any violation of these terms and conditions.

These terms and conditions shall be governed by and construed in accordance with the laws of Ireland. Any disputes arising from these terms and conditions will be subject to the exclusive jurisdiction of the courts of Ireland.
